- The mediator. Mediation.net says non attorney mediators cost less than attorney mediators and retired judges.
- How many hours. Mediation.net says most divorces take 2 to 5 sessions of 2 to 3 hours, or 4 to 15 hours in all.
- How complex your case is. The Complete Lawyer says a clean case can wrap in 6 to 10 hours, while children, retirement accounts or a business take 15 to 25 hours.
- Your city. Mediation.net says New York, San Francisco and Los Angeles mediators charge 30 to 50 percent more than mid size cities.
- What is included. Some rates include drafting the agreement. Court filing and other paperwork may be extra.
- How much you agree. Fewer disputes means fewer hours.
What the fee covers
The Complete Lawyer says the hourly rate usually includes drafting the settlement agreement and the parenting plan. It rarely includes court filing fees, QDRO drafting for retirement accounts, or deed transfers. Read the scope of work before you sign.
An attorney mediator can draft your final agreement without a second lawyer, says The Complete Lawyer, but cannot represent either of you, says Mediation.net. Mediation.net adds that many couples hire a family lawyer to review the agreement, and that a mediated divorce still needs to be filed with the court.
Most mediators split the fee between the two spouses, says The Complete Lawyer. A $6,000 flat fee package is $3,000 out of pocket for each person. Older Lawful pages also say many mediators charge a $250 to $500 set up fee and a $200 to $500 cancellation fee.
