Personal injury lawyers charge 33% to 40% of the settlement
Most personal injury lawyers work on contingency: no fee up front, and a percentage of what they recover for you. The usual rate is one third, about 33 percent, if the case settles before a lawsuit, and about 40 percent if it goes to trial. On a $50,000 settlement, that is about $16,500 to $20,000.

What the fee looks like in dollars
| Settles before a lawsuit | About 33 percent. $16,500 on a $50,000 settlement. |
|---|---|
| Lawsuit filed or trial | About 40 percent. $20,000 on $50,000. |
| Quick settlement with the insurer | Some lawyers agree to 25 percent. |
| $90,000 settlement at 33 percent | About $30,000 to the lawyer. |
| Case costs | Filing fees, records and experts, often owed win or lose. |
What pushes a quote up
| Stage of the case | The percentage often rises as the case moves toward trial. |
|---|---|
| Complexity | Harder cases can carry a higher rate. |
| Case costs | Billed on top of the fee. |
| Sliding scale | Some agreements step up by stage. |
| State rules | Some states cap or regulate fees. |
Read the agreement before you sign
Nolo notes that a contingency fee means you pay no fee if you lose, but you will probably still owe some or all of the case costs, such as court filing fees. Ask whether costs come out before or after the lawyer's percentage, because that changes what you take home.
The agreement must be in writing. Texas, for example, requires the percentage and terms to be set in writing before representation begins, under Rule 1.04 of its disciplinary rules.
