Reviving an abandoned patent application costs $2,260
If a patent application is abandoned, you can petition to revive it. The USPTO fee is $2,260 at the regular rate when the delay is one year or less, or $3,000 when it is longer. Small entities pay $904 or $1,200 and micro entities $452 or $600.

What this price covers
Applications are often abandoned by missing a deadline to respond. A petition asks the USPTO to accept that the delay was unintentional.

How we got these numbers
Every fee on this page comes from the USPTO fee schedule. Each fee has three levels: the regular fee, the small entity fee and the micro entity fee. Small and micro entity status have their own rules, set out in 37 CFR 1.27 and 1.29. The USPTO says a false small or micro entity claim can bring a penalty of at least three times the fee that was not paid. Where we show a total, we only add up the USPTO's own fees.
